Please read these terms carefully before using BestHospice.com or BestHomeHealth.org (collectively, "the Platform").
1. Platform Role
Best Hospice and Home Health is a technology platform and referral marketplace that connects families and individuals seeking hospice, palliative, and home care services with independent care providers. Best Hospice and Home Health is not a medical provider, does not provide medical advice, and does not deliver any form of healthcare services. All care is provided solely by the independent providers listed on the Platform.
2. How the Platform Works
When a family or individual submits a care request through the Platform, their contact information and general care preferences are automatically shared with verified providers serving their ZIP code area. By submitting a request, you consent to this sharing. Providers will contact you directly. Best Hospice and Home Health does not screen, filter, or prioritize which provider contacts you first.
3. No Protected Health Information (PHI)
Best Hospice and Home Health does not request, collect, or store protected health information (PHI) as defined under HIPAA, including medical records, diagnoses, insurance information, Medicare or Medicaid numbers, or Social Security numbers. Users are instructed not to submit such information through the Platform. Best Hospice and Home Health is not a HIPAA covered entity or business associate. Any health-related information voluntarily shared by users beyond what is requested is shared at the user's own risk.
4. No Endorsement of Providers
Best Hospice and Home Health does not endorse, certify, or guarantee the quality, safety, licensing, or suitability of any provider listed on the Platform. Families are encouraged to independently verify provider credentials, licensing, and Medicare certification before making care decisions. Provider listings are maintained by the providers themselves and Best Hospice and Home Health is not responsible for inaccurate or outdated listing information.
5. Provider Responsibility
Providers listed on the Platform are solely responsible for the accuracy of their listings, all communications with families, compliance with applicable federal and state laws, Medicare and Medicaid regulations, licensing requirements, and the quality and safety of all care they deliver. Best Hospice and Home Health bears no responsibility for any aspect of provider services or patient outcomes.
6. No Insurance Billing
Best Hospice and Home Health does not bill insurance, Medicare, or Medicaid on behalf of families or providers. All billing for care services is handled directly between providers and patients or their families.
7. Provider Billing and Subscriptions
Provider subscriptions, when applicable, are billed on a monthly basis and auto-renew until cancelled. Payments are processed securely through Stripe. Best Hospice and Home Health does not store full payment card details. Providers may cancel at any time. Refund terms are outlined in the Refund and Cancellation Policy.
8. Limitation of Liability
Best Hospice and Home Health, its officers, employees, and affiliates are not liable for any medical outcomes, provider actions, patient harm, errors or omissions in provider listings, decisions made by families based on Platform information, or any damages arising from the use of the Platform. Use of the Platform is at your own risk. To the maximum extent permitted by law, the total liability of Best Hospice and Home Health for any claim arising from use of the Platform shall not exceed $100.
9. No Emergency Services
Best Hospice and Home Health is not an emergency service. If you or someone you know is experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on this Platform for urgent or emergency medical needs.
10. Eligibility
You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you are at least 18 years old and have the legal authority to submit care requests on behalf of yourself or a family member.
11. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of Best Hospice and Home Health or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without written permission.
12. Termination
Best Hospice and Home Health reserves the right to suspend or terminate access to the Platform for any user or provider at any time, with or without cause, including for violation of these Terms. Providers who violate applicable laws or whose listings are found to be materially inaccurate may be removed from the Platform without notice.
13. Changes to These Terms
Best Hospice and Home Health may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. We will notify active providers of material changes via email.
14. Governing Law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Alabama.
